TERMS OF USE for BETTER DEMOCRACY

These Terms of Use set out the terms and conditions for use of BETTER DEMOCRACY (https://www.betterdemocracy.in) any mobile application(s) (Better Democracy), and any offline training, workshops, or consultancy services provided by us (collectively referred to as the “Platform”).

These Terms of Use apply to end users of the Platform (referred to as “Learners”, “You”, “Your”, “Candidates”). These Terms of Use, including the Privacy Policy and any other terms and conditions published on the Platform or communicated to you from time to time (collectively referred to as the “Agreement”), define the relationship and responsibilities between You and BETTER DEMOCRACY (referred to as “We”, “Us”, “Our”, or the “Organization”) in using the Platform.

1. CRITICAL DISCLAIMER: NO GOVERNMENT AFFILIATION BETTER DEMOCRACY is a private educational and training organization. We are NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with the Election Commission of India (ECI), the State Election Commission of Uttar Pradesh (SEC-UP), or any other State Election Commission or government agency. All content, strategies, and materials provided are for educational purposes only.

2. ACCEPTANCE OF TERMS By accessing this Platform, You are agreeing to be bound by the terms of this Agreement, all applicable laws and regulations. If You disagree with any part of this Agreement, please do not use the Platform.

3. ACCESS AND ELIGIBILITY

Age Requirement: The Platform is intended for use by individuals who are 18 (eighteen) years of age or older. By using the Platform, You represent and warrant that You are at least 18 years old. We do not knowingly permit use by minors.

Candidate Qualification Warning: While individuals aged 18+ may access the material for educational purposes, You acknowledge that under most State Panchayati Raj Acts (e.g., Uttar Pradesh Panchayat Raj Act, 1947, Bihar Panchayat Raj Act, 2006, etc.), the minimum age to contest an election is typically 21 years. It is Your sole responsibility to ensure You meet all statutory qualifications (age, no criminal conviction, solvency, etc.) before filing a nomination.

4. ELECTION LAWS AND CANDIDATE RESPONSIBILITIES You agree to strict adherence to the laws governing elections in your specific state. You explicitly acknowledge the following:

State-Specific Compliance: You are responsible for identifying and complying with the Panchayati Raj Act and State Election Commission Rules applicable to the state where You are contesting (e.g., Uttar Pradesh, Bihar, Madhya Pradesh, Chhattisgarh, etc.).

Model Code of Conduct (MCC): You agree that You are solely responsible for ensuring Your campaign activities, speeches, and social media posts comply with the Model Code of Conduct (MCC) once it is enforced by the State Election Commission. You agree NOT to use our strategies to violate MCC rules (e.g., bribing voters, inciting community disharmony).

Election Expenditure: You understand that fees paid to BETTER DEMOCRACY for training or consultancy may be classified as "Election Expenditure" under the relevant State Election Commission guidelines if purchased during the active election period. It is Your sole responsibility to include these costs in Your official expenditure account submitted to the Returning Officer. We do not provide legal or accounting advice regarding expenditure filings.

5. REGISTRATION AND ACCOUNTS To access any Content, we require You to register by providing Your name, email address, and phone number. You represent that the information indicated by You is true and complete. You are responsible for maintaining the confidentiality of Your account credentials. Sharing of login credentials with campaign teams, volunteers, or other candidates is strictly prohibited. If we detect concurrent logins or suspicious activity, We reserve the right to suspend Your account without refund.

6. LICENSE TO USE You are granted a limited, non-exclusive license to access and view the Content on the Platform for Your own personal, non-commercial use only. This license does not grant You the right to:

Modify, edit, copy, or reproduce the Content or materials;

Create derivative works or exploit any material for commercial purposes;

Publicly display the Content (e.g., projecting course videos to a group of people in an offline setting without our permission);

Attempt to decompile or reverse engineer any software contained in the Platform;

Remove any copyright or proprietary notations from the materials; or

Transfer the materials to another person or 'mirror' the same on any other server.

This license shall automatically terminate if You violate any of these restrictions. Upon termination, You must destroy any downloaded materials in Your possession.

7. OFFLINE TRAINING AND WORKSHOPS If You attend our offline workshops or physical training sessions:

We reserve the right to deny admission or remove any participant who disrupts the session, behaves inappropriately, or violates the safety/dignity of other participants or staff.

Recording of offline sessions (audio or video) by participants is strictly prohibited unless explicitly authorized.

8. CODE OF CONDUCT You agree to use the Platform only for lawful purposes. You agree NOT to:

Hate Speech & Misinformation: Upload or share content that promotes enmity between groups on grounds of religion, race, caste, or community, or that constitutes "fake news" or election misinformation.

Harassment: Engage in harassment, bullying, or abusive behavior toward instructors or other learners.

Harmful Content: Post content inciting violence or illegal acts.

Spam: Post untargeted, repetitive content or links to third-party sites.

Impersonation: Impersonate another person, candidate, or government official.

Technical Harm: Introduce viruses, malware, or attempt to gain unauthorized access to the Platform (hacking/cracking).

9. COMMUNICATIONS AND USER CONTENT If You post content in Public Forums (e.g., WhatsApp groups, discussion boards), You grant us a non-exclusive, royalty-free, perpetual right to use, reproduce, and display such content. You are solely responsible for the information You choose to share. We are not responsible for the actions of other users in these forums.

10. INTELLECTUAL PROPERTY We own all information and materials, including Content, trademarks, logos, course structures, and video files ("Creator’s Intellectual Property"). You acknowledge that You do not acquire any ownership rights by using the Platform. Unauthorized use of our IP is strictly prohibited.

11. PAYMENTS AND REFUNDS

Fees: Pricing is listed on the Platform. Payment is processed through third-party gateways.

No Refunds: Once You purchase access to Content (online or offline), the fee is non-refundable, unless otherwise stated in a specific Refund Policy for a specific event.

Taxes: You are responsible for applicable taxes (e.g., GST).

12. DISCLAIMER OF WARRANTIES THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE STRATEGIES TAUGHT WILL RESULT IN AN ELECTION VICTORY. ELECTION OUTCOMES DEPEND ON EXTERNAL FACTORS BEYOND OUR CONTROL. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

13. LIMITATION OF LIABILITY In no event shall BETTER DEMOCRACY be liable for any damages (including loss of data, profit, or election failure) arising out of the use or inability to use the Platform, even if we have been notified of the possibility of such damage.

14. INDEMNITY You shall indemnify and hold harmless BETTER DEMOCRACY, its officers, directors, and employees from any claim, penalty, or legal action arising out of Your breach of this Agreement, Your violation of Election Laws/MCC, or Your violation of the rights of a third party.

15. MISCELLANEOUS

Alteration: We reserve the right to make changes to this Agreement at any time.

Waiver: If we take no action upon a breach, it does not waive our rights to take action in the future.

Assignment: You may not assign this Agreement to anyone else.

Severability: If any provision is deemed unenforceable, the remaining provisions will remain in effect.

Force Majeure: We will not be held responsible for any delay or failure to comply with our obligations if the delay arises from any cause beyond our reasonable control (e.g., internet failure, pandemics, government orders).

16. GOVERNING LAW AND JURISDICTION Any claim relating to the Platform shall be governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts at Lucknow-Uttar Pradesh, India.
