This Privacy Policy (the "Policy") governs the manner in which BETTER DEMOCRACY (hereinafter referred to as “We”, “Us”, “Our”, or the “Organization”) collects, uses, maintains, and discloses information of users of the betterdemocracy.in website, any associated mobile applications, and participants in our offline training/workshops (collectively referred to as the “Platform”).

This Policy applies to all end users (referred to as "Learners", "You", "Your", or "Candidates").

By accessing and using the Platform, providing Your Personal Information, or by otherwise signaling Your agreement when the option is presented to You, You consent to the collection, use, and disclosure of information described in this Policy and our Terms of Use. If You do not agree with any provisions of this Policy, You should not access or use the Platform.

1. DEFINITIONS

Capitalized terms used but not defined in this Privacy Policy shall have the meaning given to them in our Terms of Use.

"Personal Information" shall mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person. This includes name, email, phone number, age, gender, location, and photograph.

"Sensitive Personal Information" shall include (i) passwords; (ii) financial information such as Bank account or credit card or debit card or other payment instrument details; (iii) physical, physiological and mental health condition; (iv) biometric information; (v) official identifiers (Aadhaar, PAN, Voter ID); and (vi) political affiliation or opinion data collected for the purpose of training strategy.

"Election Data" refers to specific information regarding the Constituency (Gram Panchayat, Zila Panchayat, Vidhan Sabha), the post contested, and campaign-specific details provided by the Learner.

2. INFORMATION WE COLLECT

We may collect both personal and non-personal identifiable information from You in a variety of ways:

A. Information You Voluntarily Provide

Registration Data: Name, Email Address, Mobile Number, Residential Address, and Date of Birth/Age (to verify eligibility).

Candidate Profile: To provide relevant election strategy, we may collect details about the specific election post You are contesting (e.g., Gram Pradhan, BDC Member) and your Constituency/Ward details.

Offline Workshop Data: If You attend our physical training camps, we collect attendance records, physical feedback forms, and photographs/videos of the sessions.

Payment Information: Billing name, address, and GST details (if applicable). Note: We do not store complete credit/debit card numbers on our servers. Transactions are processed by secure third-party gateways.

B. Information Collected Automatically

Log Data: When You use our App or Website, we collect data such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app, the time and date of your use, and other statistics.

Course Progress: We track your interaction with the content (videos watched, PDFs downloaded, quizzes attempted) to assess performance and issue Certificates.

C. Cookies Our Platform uses "cookies" to enhance User experience. A cookie is a small file placed on your device to retain your login session or preferences. You may choose to set Your web browser to refuse cookies; however, please note that in doing so, some parts of the Platform (such as tracking course completion) may not function properly.


3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following specific purposes:

1. Service Delivery: To allow You to access the Platform, view content, attend live sessions, and receive customer support. 2. Election Law Compliance & Expenditure: To generate valid invoices and receipts. You acknowledge that fees paid to BETTER DEMOCRACY may need to be declared as "Election Expenditure" under State Election Commission rules. We retain these records to assist You in case of an expenditure audit.  3. Communication & Automation: We use your contact details (specifically WhatsApp and Email) to send: * Course login credentials. * Automated daily strategy tips. * Reminders for upcoming webinars or offline workshops.4. Platform Security: To detect fraud, abuse, and illegal activity, specifically "Account Sharing" (which is a violation of our Terms). We monitor concurrent logins to ensure one account is used by one candidate only. 5. Improvement: To analyze user behavior and improve our course curriculum and app functionality.

4. CAMPAIGN CONFIDENTIALITY AND SHARING

We recognize that as a political candidate, the privacy of your campaign strategy is critical.

A. Strict Non-Disclosure to Rivals We DO NOT sell, trade, or share Your Personal Information, constituency strategy, or political notes with rival political parties, other candidates, or election survey agencies. Your strategic data is used solely for Your educational benefit.

B. Sharing with Service Providers We may employ third-party companies to facilitate our Service. These third parties have access to Your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. These include:

LMS Hosting: (e.g., Graphy/Classplus) for video streaming.

Payment Gateways: (e.g., Razorpay/Instamojo) for processing fees.

Automation Tools: (e.g., WhatsApp Business API providers, Email services).

C. Legal Disclosure We reserve the right to disclose your information when required by law, such as:

In response to a court order or subpoena.

In response to a request from the Election Commission of India (ECI) or State Election Commissions (e.g., SEC Uttar Pradesh/Bihar) regarding expenditure verification or Model Code of Conduct violations.

To protect the rights, property, or safety of BETTER DEMOCRACY, our users, or others.

5. DATA SECURITY

We take all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of Personal Information.

Data Storage: Your data is stored on secure cloud servers (e.g., AWS/Google Cloud) located primarily in India.

Encryption: Sensitive data (like passwords) and payment transactions are transmitted via Secure Socket Layer (SSL) technology.

Access Control: Access to your data is restricted to authorized employees and contractors who need to know that information to process it on our behalf.

However, no method of transmission over the Internet is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.


6. USER RIGHTS (INDIAN & GENERAL)

Regardless of where you are located, we provide the following rights to all Learners, aligned with the Digital Personal Data Protection Act, 2023 (India):

Right to Access: You have the right to request a summary of the personal data we hold about You.

Right to Correction: You can ask us to update or correct any inaccurate or incomplete Personal Information (e.g., change of Phone Number or Constituency).

Right to Erasure (Right to be Forgotten): You may request that we delete your account and personal data. Note: We may deny this request if retaining the data is required by law (e.g., retaining Tax Invoices for 5-8 years for GST/Election Audit purposes).

Right to Grievance Redressal: You have the right to register a grievance regarding the processing of your data.

7. OFFLINE TRAINING AND MEDIA RELEASE

For Learners attending our offline workshops/camps:

Photography/Video: By attending an offline event, You grant BETTER DEMOCRACY the right to record, film, and photograph the event. You consent to the use of your image in our marketing materials and social media.

Opt-Out: If You do not wish to be photographed, You must inform the event organizer at the venue registration desk.


8. RETENTION OF DATA

We will retain Your information for as long as your account is active or as needed to provide You services. We will also retain and use Your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

General Account Data: Retained until account deletion.

Financial/Invoice Data: Retained for a minimum of 8 years as per Indian Income Tax Laws.

9. THIRD-PARTY WEBSITES

The Platform may contain links to third-party websites (e.g., Election Commission websites, News portals). We are not responsible for the privacy practices or content of those third-party sites. We encourage You to read the privacy policies of each site You visit.


10. CHANGES TO THIS PRIVACY POLICY

We may update this Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify You of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this Policy periodically for any changes.
